With a new year starting, very often, there goes with it new laws that come into play. Beginning January 2012, commercial motor vehicle operators are banned from using hand-held mobile phones while driving. The ban is being implemented by the Federal Motor Carrier Safety Administration. The basis for the new law is the research and studies, which has shown, time and again, that using such communication devices while driving is a huge safety risk. The new truck driver rule prohibits drivers from reaching for, holding, or dialing a mobile phone while driving. The ban applies when the commercial vehicle is in operation on the roadway, when it is temporarily stopped in traffic, or when the commercial vehicle is waiting at a stop light, stop sign or other traffic device. Commercial drivers with multiple violations of the new rule could face driver disqualification and fines. Companies that allow their drivers to use hand-held devices can also face fines.
The Stewart Law Firm is dedicated to serving the needs of those injured by the fault of others. We see first-hand the losses caused by distracted driving. Based on the size variance between commercial trucks and passenger vehicles, we believe that the new law is beneficial. When a commercial truck driver takes his or her attention off of the roadway for even a split second, catastrophic and life-changing events can occur.
