OSHA Proposes $1 Million Plus Fine to Houston, Texas Company

According to a press-release, the U.S. Department of Labor's Occupational Safety and Health Administration (OSHA)has cited Piping Technology and Products Inc. for 13 willful and 17 serious violations for exposing workers to the risk of amputations and other serious injuries from dangerous machinery, as well as other hazards, at the company's Houston facility. Proposed penalties total $1,013,000. "Repeatedly ignoring the law while risking workers' lives and providing misleading information to federal investigators will not be tolerated," said Secretary of Labor Hilda L. Solis. "Employers who endanger the lives and limbs of their employees must be held accountable."

A worker at Piping Technology contacted OSHA earlier this year, alleging a lack of brakes on overhead cranes and unguarded presses at the company's facility on Holmes Road. This complaint triggered an investigation by OSHA's Houston South Area Office. In addition to substantiating the complaint items, the inspection found that employees were permitted to cut metal I-beams and pipes without the proper machine guarding, which exposed them to possible severe injuries. Additionally, OSHA inspectors found that during machine maintenance, workers were exposed to the unexpected release of stored energy because of improper safeguards.

Interesting Holiday Decoration Safety Tips

Before crawling up on the roof to string the Christmas lights, you need to know that every year, hospital emergency rooms treat about 12,500 people for injuries, such as falls, cuts and shocks, related to holiday lights, decorations and Christmas trees, according to the U.S. Consumer Product Safety Commission (CPSC).

In addition, warns CPSC, candles start about 11,600 each year, resulting in 150 deaths, 1,200 injuries and $173 million in property loss. Christmas trees are involved in about 300 fires annually, resulting in 10 deaths, 30 injuries and an average of more than $10 million in property loss and damage.

"Sometimes people are having such a nice time during the holidays that they forget to extinguish candles," said CPSC Chairman. "Always put out lit candles before leaving a room or going to bed. Always keep burning candles within sight. Also, make sure your holiday lights bear the mark of a recognized testing lab to show they meet safety standards."

Since CPSC started monitoring holiday lights and decorations sold at stores nationwide, inspectors have prevented the import of 116,500 units of holiday lights that did not meet safety standards.

CPSC tips to make your holiday a safe one:

Trees:

When purchasing an artificial tree, look for the label "Fire Resistant." Although this label does not mean the tree won't catch fire, it does indicate the tree will resist burning and should extinguish quickly.
When purchasing a live tree, check for freshness. A fresh tree is green, needles are hard to pull from branches and do not break when bent between your fingers. The trunk butt of a fresh tree is sticky with resin, and when tapped on the ground, the tree should not lose many needles.
When setting up a tree at home, place it away from fireplaces and radiators. Because heated rooms dry live trees out rapidly, be sure to keep the stand filled with water. Place the tree out of the way of traffic and do not block doorways.

Lights:

Indoors or outside, use only lights that have been tested for safety by a recognized testing laboratory, which indicates conformance with safety standards. Use only lights that have fused plugs.
Check each set of lights, new or old, for broken or cracked sockets, frayed or bare wires, or loose connections, and throw out damaged sets. Always replace burned-out bulbs promptly with the same wattage bulbs.
Use no more than three standard-size sets of lights per single extension cord. Make sure the extension cord is rated for the intended use.
Never use electric lights on a metallic tree. The tree can become charged with electricity from faulty lights, and a person touching a branch could be electrocuted.
Before using lights outdoors, check labels to be sure they have been certified for outdoor use.
Stay away from power or feeder lines leading from utility poles into older homes.
Fasten outdoor lights securely to trees, house walls, or other firm supports to protect the lights from wind damage. Use only insulated staples to hold strings in place, not nails or tacks. Or, run strings of lights through hooks (available at hardware stores).
Turn off all holiday lights when you go to bed or leave the house. The lights could short out and start a fire.
Use caution when removing outdoor holiday lights. Never pull or tug on lights - they could unravel and inadvertently wrap around power lines.
Outdoor electric lights and decorations should be plugged into circuits protected by ground fault circuit interrupters (GFCIs). Portable outdoor GFCIs can be purchased where electrical supplies are sold. GFCIs can be installed permanently to household circuits by a qualified electrician.

Decorations:

Use only non-combustible or flame-resistant materials to trim a tree. Choose tinsel or artificial icicles of plastic or nonleaded metals. Leaded materials are hazardous if ingested by children.
Never use lighted candles on a tree or near other evergreens. Always use non-flammable holders, and place candles where they will not be knocked down.
In homes with small children, take special care to avoid decorations that are sharp or breakable, keep trimmings with small removable parts out of the reach of children to avoid the child swallowing or inhaling small pieces, and avoid trimmings that resemble candy or food that may tempt a child to eat them.
Wear gloves to avoid eye and skin irritation while decorating with spun glass "angel hair."
Follow container directions carefully to avoid lung irritation while decorating with artificial snow sprays.

Fireplaces:

Use care with "fire salts," which produce colored flames when thrown on wood fires. They contain heavy metals that can cause intense gastrointestinal irritation and vomiting if eaten. Keep them away from children.
Do not burn wrapping papers in the fireplace. A flash fire may result as wrappings ignite suddenly and burn intensely.

OSHA Cites Liberty, TX Company After Workers Hurt

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) has cited Boomerang Tube LLC for six willful, nine serious and one other-than-serious violation at the company's facility in Liberty, Texas where three employees were seriously injured within a period of five months. Proposed penalties total $468,000. According to OSHA press-releases, the employer jeopardized the safety of its employees by failing to follow OSHA's safety standards for energy control procedures and machine guarding. OSHA's Houston North Area Office began an investigation June 14 in response to a complaint from one of the injured employees that workers faced unsafe conditions while operating cranes and slitter, rolling and thread machines; performing service and maintenance work; and stacking and loading pipes in the yard and on trucks at the company's work site on Farm to Market 3361. In April, an employee was injured from becoming caught in an operating machine and in May, a second employee was struck by a piece of steel and knocked into a 5-foot-10-inch concrete pit. In September, another employee was injured from becoming caught in machinery. All three had to be flown to a local hospital due to the severity of their injuries.

WASHINGTON - Following today's Board meeting on the 2010 multi-vehicle highway accident in Gray Summit, Missouri, the NationalTransportation Safety Board (NTSB) called for the first-ever nationwideban on driver use of personal electronic devices (PEDs) while operating a motor vehicle.

The safety recommendation specifically calls for the 50 states and the District of Columbia to ban the nonemergency use of portable electronic devices (other than those designed to support the driving task) for all drivers. The safety recommendation also urges use of the NHTSA model of high-visibility enforcement to support these bans and implementation of targeted communication campaigns to inform motorists of the new law and heightened enforcement.

"According to NHTSA, more than 3,000 people lost their lives last year in distraction-related accidents", said Chairman Deborah A.P. Hersman. "It is time for all of us to stand up for safety by turning off electronic devices when driving." "No call, no text, no update, is worth a human life." On August 5, 2010, on a section of Interstate 44 in Gray Summit, Missouri, a pickup truck ran into the back of a truck-tractor that had slowed due to an active construction zone. The pickup truck, in turn, was struck from behind by a school bus. That school bus was then hit by a second school bus that had been following. As a result, two people died and 38 others were injured.

The NTSB's investigation revealed that the pickup driver sent and received 11 text messages in the 11 minutes preceding the accident. The last text was received moments before the pickup struck the truck-tractor. The Missouri accident is the most recent distraction accident the NTSB has investigated. However, the first investigation involving distraction from a wireless electronic device occurred in 2002, when a novice driver, distracted by a conversation on her cell phone, veered off the roadway in Largo, Maryland, crossed the median, flipped the car over, and killed five people.

Since then, the NTSB has seen the deadliness of distraction across all modes of transportation.

* In 2004, an experienced motorcoach driver, distracted on his hands-free cell phone, failed to move to the center lane and struck the underside of an arched stone bridge on the George Washington Parkway in Alexandria, Virginia. Eleven of the 27 high school students were injured;

* In the 2008 collision of a commuter train with a freight train in Chatsworth, California, the commuter train engineer, who had a history of using his cell phone for personal communications while on duty, ran a red signal while texting. That train collided head on with a freight train – killing 25 and injuring dozens;

* In 2009, two airline pilots were out of radio communication with air traffic control for more than an hour because they were distracted by their personal laptops. They overflew their destination by more than 100 miles, only realizing their error when a flight attendant inquired about preparing for arrival;

* In Philadelphia in 2010, a barge being towed by a tugboat ran over an amphibious "duck" boat in the Delaware River, killing two Hungarian tourists. The tugboat mate failed to maintain a proper lookout due to repeated use of a cell-phone and laptop computer; and

* In 2010, near Munfordville, Kentucky, a truck-tractor in combination with a 53-foot-long trailer, left its lane, crossed the median and collided with a 15-passenger van. The truck driver failed to maintain control of his vehicle because he was distracted by use of his cell-phone. The accident resulted in 11 fatalities.

In the last two decades, there has been exponential growth in the use of cell-phone and personal electronic devices. Globally, there are 5.3 billion mobile phone subscribers or 77 percent of the world population. In the United States, that percentage is even higher - it exceeds 100 percent.

Further, a Virginia Tech Transportation Institute study of commercial drivers found that a safety-critical event is 163 times more likely if a driver is texting, e-mailing, or accessing the Internet. "The data is clear; the time to act is now. How many more lives will be lost before we, as a society, change our attitudes about the deadliness of distractions?" Hersman said. Ford Motor Company has issued a recall of about 129,000 vehicles after it was discovered that the vehicle's wheels can unexpectedly fall off. Texas Drilling Company Cited After Worker Electrocuted

According to news reports, the U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) has cited Ringo Drilling I LP, headquartered in Tye, with seven safety violations after an employee performing repair work on an oil drilling rig was electrocuted at the company's worksite near Ozona, Texas in June.

The company was issued four serious citations for failing to provide training on the hazards of electrical equipment, provide guardrails to prevent workers from falling into a hole more than 4 feet deep near the well head, ensure proper use of stepladders and properly guard electrical junction boxes. A serious violation occurs when there is substantial probability that death or serious physical harm could result from a hazard about which the employer knew or should have known.

Three repeat citations were issued for failing to protect workers from falls on platforms and other work areas by providing guardrails, inspect electrical cord sets and ensure that electrical cables were provided with proper strain relief. A repeat violation exists when an employer previously has been cited for the same or a similar violation of a standard, regulation, rule or order at any other facility in federal enforcement states within the last five years. OSHA cited the company in 2008 and 2010 for similar violations.

"Exposing workers to electrocution hazards without proper safeguards and training is inexcusable. This is not the first time the same employer has jeopardized the safety of its workers by failing to follow OSHA standards," said Jeff Funke, the agency's area director in San Antonio. "It is the employer's responsibility to create a safe and healthful workplace where preventable hazards don't cost workers their lives."

Proposed penalties total $130,200. The company, which employs about 300 workers across West Texas, has 15 business days from receipt of the citations to comply, request an informal conference with OSHA's San Antonio Area Office or contest the citations and penalties before the independent Occupational Safety and Health Review Commission.
